USCIS Will Not Issue Refunds for Duplicate I-485 Applications


As part of our Firm's commitment to monitoring the latest news and events within the legal industry, We have seen some interesting developments coming from the USCIS on the major issues in processing and examining I485 AOS Petitions. Aila has advised that some Petitioners, in anticipation of receiving rejected I-485 applications, filed a second I-485 application for the same in anticipation that the Original Petition would be rejected. This has resulted in some cases, where two I-485 applications with two sets of filings fees cashed for the same beneficiary.


The USCIS has advised to not send in a second application while the porginal is waiting on approval receipt or rejection. In turn they will not be issuing refunds at the moment for paying the filing fees on two petitions.
