On October 5, 2022 the USCIS issue a press release on the rollout of I-140 Premoum Processing category expansion. the statment reads as follows:
U.S. Citizenship and Immigration Services (USCIS) has been expanding premium processing in phases to certain pending Forms I-140, Immigrant Petition for Alien Workers under the EB-1 and EB-2 classifications. Recently, USCIS announced that you can file a premium processing request if you have a pending Form I-140 for the following classifications and filing dates:
E13 multinational executive or manager and the Form I-140 receipt date is on or before Jan. 1, 2022; and
E21 member of professions with advanced degrees or exceptional ability seeking a national interest waiver (NIW), and the Form I-140 receipt date is on or before Feb. 1, 2022.
USCIS will reject your premium processing request if your Form I-140 receipt date is after the date listed above. Additionally, USCIS is not accepting premium processing requests for new (initial) Forms I-140 in the E13 and E21 classifications at this time.
Why This Matters
Many stakeholders have expressed a strong desire for expanded premium processing options. Since June, USCIS has expanded access to premium processing every month and generally moved the accepted Form I-140 receipt dates up by a few months at a time.
USCIS is expanding premium processing to additional form types in order to increase efficiency and reduce burdens to the overall legal immigration system. At the same time, pursuant to the Emergency Stopgap USCIS Stabilization Act, USCIS must ensure that implementation or expansion of premium processing does not result in an increase in processing times for immigration benefit requests not designated for premium processing. Therefore, USCIS has implemented the expansion of premium processing in a phased approach for Form I-140, Immigrant Petition for Alien Workers, Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization.
